How Does An Uncontested Divorce Work?

There are two ways your case will be considered ‘uncontested.’ The first comes in to play if either you or your spouse do not respond to the petition for divorce or separation. Under California law, the spouse filing for divorce or separation is required to notify their partner by serving the necessary papers. The person receiving the papers then has 30 days to file their response with the court, and if they fail to do so the court will proceed without their input and will likely agree with the terms laid out in the original filing.

If you choose to respond to the petition, you can either give up your right to have any say in the divorce proceedings or state that you agree with the terms set by your spouse. Giving up your right to have a say in the proceedings will result in a similar situation as the one outlined if you don’t respond at all. If you agree with your spouse, then you will be required to assist them in filling out all of the necessary paperwork. Can I Back Out Of An Uncontested Divorce?

Even an uncontested divorce can take time to complete, and during that time you may change your mind and realize that you want to challenge some of the terms of your divorce. You are free to change your mind and pursue a contested divorce up until both you and your spouse sign a Separation Agreement. While it’s possible to return to negotiations after you sign the form, it will require extra paperwork and potentially require you to request that the court cancel any scheduled court dates.
