What Factors Are Used To Determine Child Custody?

Often times, child custody is the most emotional and sensitive issue when people are going through a divorce or paternity action. The emotional scars are not only borne by the parents, but the children as well. Through all the fighting and negotiating, parties often forget that children are also affected when parents separate. In order to ensure that the children are not an afterthought, courts use their powers to determine the "best interest of the children."

In determining the "best interest of the child," courts consider the factors listed in California Family Code Section 3011.
